The following privacy and cookies policy sets out how we use data relating to you and applies to all use of data by Breaking Fourth Limited of 23 Tileyard Studios,  London N7 9AH. (“we”, “us” or “our”). This privacy policy forms a part of the terms of use, which can be found on our website: www.breakingfourth.com.

Collectively, we describe our products and services – including our website (www.breakingfourth.com), content (including without limitation, our virtual play entitled “CTRL”), our newsletter, and services – as our “Services”.

This privacy and cookies policy (together with the documents referred to in it) sets out the basis on which any personal data we collect from you, or that you provide to us, through the Services will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

This policy does not apply to practices of companies that we do not own or control, or to individuals that we do not employ or manage.

1. ABOUT THE SERVICES AND THIS PRIVACY/COOKIES POLICY

Breaking Fourth create compelling and innovative stories using cutting edge VR technology to drop you right into the heart of the action, where sounds, scale, story, and emotions are heightened to realistic levels. You are no longer just a passive spectator -- you are part of the story. Our virtual reality play, CTRL, combines revolutionary VR technology with the excitement and emotional intensity of theatre to produce an immersive theatrical experience like no other.

2. DATA WE MAY COLLECT

2.1 We may ask you for, or you may submit, certain personal and non-personal information and data to us through the Services when you register or otherwise use the Services. This includes:

  • your name and address;

  • your e-mail address; and

  • any other content you submit to us via the Services (collectively, “Your Content”), such as comments and marketing preferences and other information concerning your use of the Services.

2.2 We may also automatically collect and process data about how a user has engaged with our Services. This could include the following “Technical Information”:

  • the type of device that you are using (e.g. type of VR headset, PC, or mobile device);

  • a unique device identifier;

  • your browser or operating system; and

  • your Internet Protocol (“IP”) address.

Such Technical Information is anonymous.

3. USES OF DATA

3.1 All information we hold will be kept securely in accordance with an internal security policy and may be used as follows:

  • Your name and e-mail address: to send you our newsletter (where you have subscribed), and to contact you with news, or notify you about changes to our services;

  • Your Content: to process and make available Your Content to the Services and to market to you in accordance with your instructions.

3.2 Information submitted to us via the Services, including any Technical Information, may also be used to:

  • enable our compliance with applicable laws and regulations;

  • generally run and improve the Services to ensure that content is presented in the most effective manner for you and your device;

  • as part of our efforts to keep our Services safe and secure;

It may also be processed by staff operating outside the EEA who work for us or our suppliers. These staff may be engaged in the processing of your orders, payment details and the provision of support services.

4.5 Although we will do our best to protect your personal data, we cannot guarantee the security of data transmitted to us via the Services.  Any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

4.6 When you get in contact with us (for example by email) we will keep records of what is communicated.  This is to ensure we have a record of our discussion for future reference so we can provide the service to you more efficiently.

4.7 We may anonymise information about you (so that you cannot be identified from it by third parties) and provide that information to third parties for the purposes of marketing analysis or to market the Services.

5. COOKIES AND ANALYTICS

5.1 We may use cookies or other similar tools within the Services, and by using the Services you consent to this use.

5.4 We work with third parties who may also set cookies through our Services:

  • We use Web-Stat by Web Tracking Services LLC to display content and to monitor how visitors use the Service. It counts the number of visitors and tells us things about their behaviour overall, such as typical length of stay on our site or the average number of pages a user views. This information generated by the cookie about your use of our site may be transmitted to and stored by Web-Stat on their servers. Web-Stat will use this information for the purpose of evaluating your use of our site, compiling reports on website activity and providing other services relating to website activity;

  • Our newsletter/mailing list service provided by Wix.com Limited (“Wix”) may collect information that users who subscribe to our mailing list provide, such as names and email addresses. Newsletters sent by us using the Wix “Campaign Manager” service may include single pixel gifs called clear gifs (aka web beacons/web bugs). Wix uses these web beacons to collect information about how users use the newsletters that we send to them, so as to improve their newsletter service. The information is stored by Wix on their servers based in Israel.

6. MARKETING AND E-MAIL COMMUNICATIONS

6.1 You can sign up to our newsletter via our website by entering your name and email address and submitting these details to us by clicking on the “Sign up now” button, and we will sent you regular updates about our Services.

6.2 The newsletter/mailing list service provided by Wix helps us to create, send and manage the newsletters that we send to those users who have subscribed to our mailing list via our site.

6.3 If you no longer wish to receive our newsletter you can contact us directly and request that we delete your data. Each newsletter we sent to you shall also include an option to “unsubscribe” from our newsletter. If at any time you no longer wish to receive our newsletter please click the “unsubscribe” link in the latest newsletter email you receive and we shall remove your from our mailing list.

6.4 Where you have given us consent to contact you we might send you marketing emails about products or services which are similar to or related to the Services, or contact you by email with information about the Services and/or special offers. We will not send you any other marketing emails or pass your information on to third parties unless you give your consent or you have given it already.

7. DISCLOSURE OF YOUR INFORMATION

7.1 We may disclose personal information about you to other members of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006, or to trusted third parties, (both inside and outside the European Economic Area) to enable us to receive facilities which help us operate the Services.

7.2 We may share your information with selected third parties including:

  • Business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you, and to the Services.

  • Analytics and search engine providers that assist us in the improvement and optimisation of our Services.

9.1 If you follow a link from the Services to any third party websites, apps or content, you should be aware that those websites, apps or content may have their own privacy policies.  We do not accept any responsibility or liability for those websites/apps.  Please check the policies of any third party websites/apps before submitting any personal data to those websites.

9.2 We may make changes to this privacy and cookies policy in the future, which will be posted on this page.  You should check this page from time to time to ensure you are aware of any changes.  Where appropriate we may notify you of changes by email or through our Website.
